DENR-9 Files Additional Charges Against Commercial Fishing Vessel for Environmental Violation

           The Department of Environment and Natural Resources (DENR) Region 9 office last Wednesday filed additional charges against the owner, officers and crew of one of the five (5) commercial fishing vessels which were apprehended earlier within the waters of Turtle Islands Wildlife Sanctuary (TIWS) in Tawi Tawi for allegedly violating Section 20 (a) of Republic Act 7586 otherwise known as the National Integrated Protected Areas System (NIPAS) Act of 1992 at the Office of the Provincial Prosecutor of Tawi-Tawi.

             DENR 9 Regional Director Carlito M. Tuballa instructed Assistant Regional Director Ronald D. Gadot and Conservation and Development Division Chief Cidur S. Julsadjiri to file additional charges against the owner, officers and crew of commercial fishing vessel F/B Sabrina DR 9 with the surfacing of new evidences and testimony from a witness for allegedly violating Section 20(a) of RA 7586 which is the “Hunting, destroying, disturbing or mere possession of any plants or animals or products derived therefrom without permit from the Management Board.”

Earlier, the said owners, officers and crew of the five commercial fishing vessels were charged by DENR-9 for alleged violation of RA 7586, Section 20 (c) which penalizes the “use of motorized equipment without permit from the Management Board” within a protected area. The Bureau of Fisheries and Aquatic Resources (BFAR) also filed a complaint against them for violation of the Fisheries Code of the Philippines.

Named respondents to the complaint are Rolando del Rosario boat owner of F/B Sabrina DR 9 from Tacloban City, Wilfredo Manzanares (Boat Captain) and Julius M. Ching from Malabon City, Rommel J. Maligat from Mandaluyong CityRonald B. Taroso, Jose B. Dumaplin, Cesar S. Domingo, Jose P. Llurag, Joey L. Taboso, , Alberto Albaracoso, Reynaldo D. Cases, Reynaldo B. Abiner and Elpidio B. Alolor all from Navotas City.

The said commercial fishing vessel, together with four others, were apprehended by the PNP Maritime Group allegedly fishing within the waters of Turtle Islands Wildlife Sanctuary, a declared protected area and wildlife sanctuary for endangered marine turtles under Presidential Proclamation 171.

All of the 5 commercial fishing vessels are currently under the custody of BFAR in Bonggao Wharf, Tawi-Tawi. (rtan).
